Bam Margera’s estranged wife, Nicole Boyd, has hit back at his claim that she’s keeping him from their son.

This comes after TMZ obtained court documents that the former ‘Jackass’ star asked a judge for an earlier court hearing because Boyd is allegedly not allowing him to see their five-year-old son Phoenix.

The legal separation case is currently scheduled for July 11.

However, the model responded to the claims with her own documents, claiming there is no reason to change the date of the hearing as she is currently abiding by the custody orders.

She also claims that Margera is able to spend time with Phoenix as long as he’s in California and sober, as per TMZ.

“Mr. Margera continues to claim to be the ‘injured’ party because he isn’t seeing Phoenix — even though he placed himself 3,000 miles away after exposing the child to abuse and drug/alcohol abuse,” her lawyer told the outlet.

The pair had a matrimonial ceremony in Reykjavik, Iceland back in October 2013. The video was featured on Margera’s YouTube channel, but it has since been deleted.

He’s also filed to dismiss Boyd’s request for a legal separation, claiming they “have never been married, legally or otherwise.”

“To my knowledge, Boyd has never legally changed her name in any state to ‘Nicole Margera,’” he told the court. “Every driver’s license or other form of identification I have seen Boyd possess bears the name ‘Nicole Boyd.’”

It’s unknown whether the pair ever got a marriage license in the United States.

Boyd filed for legal separation back in February, citing irreconcilable differences. She also requested legal and physical custody of Phoenix, as well as spousal support.

The filing came after it was revealed Boyd had concerns about Margera’s behavior around Phoenix. Her lawyer claimed she saw him act “inappropriately” around their son, and that she believed he was under the influence, something he denies.
