Reese Witherspoon officially files for divorce from Jim Toth
The couple announced their split last week with a joint statement.
Actress Reese Witherspoon has officially filed for divorce from Jim Toth. The two announced their split on March 24 in a joint statement posted to Witherspoon’s Instagram account.
Details from the court documents
According to court documents obtained by TMZ, the divorce was filed in Nashville, Tennessee, where the couple resided and was raising their 10-year-old child, Tennessee. Witherspoon and Toth welcomed their son in 2012 shortly after getting married.
In the documents, Witherspoon says that she and Toth signed a prenup in March 2011 at the time of the marriage. She added that the agreement is valid, providing “adequate and sufficient provisions” for their assets and debts.
The ‘Legally Blonde’ actress says she will submit the prenup and a permanent parenting plan for the care of their child to the judge for approval.
However, all Davidson County Divorce cases involving a child require parents to enroll in a mandatory parenting class. So Witherspoon and Toth will have 60 days to submit a certificate of completion of the course to the court.
The couple married in March 2011 after meeting at a party sometime in 2010 and less than a year of dating. A year later they welcomed their sole child together.
After celebrating their 10-year wedding anniversary with a sentimental throwback photo posted on Witherspoon’s Instagram, the couple would end up calling it quits just over two years later.
Less and less time together
According to Daily Mail, Witherspoon cited irreconcilable differences as the reason behind their split in the documents. According to a source close to the couple, the two had been spending “less and less time together”
Just before their 12-year anniversary, the source explains that the couple “found themselves with fewer interests in common.”
The source told People Magazine that it was “very difficult” for the movie star to accept that she and her former partner, 52, were “two very different people.”
Long time coming
According to Page Six, Witherspoon and Toth’s split wasn’t a surprise to most insiders. Apparently, the divorce was a long time coming and a “badly kept secret in the industry for months.”
“Word around the punch bowl at agency holiday parties last year was that an announcement was coming any minute, we hear,” wrote the outlet.
