Tom Brady and Gisele Bündchen have officially filed for divorce, as of Friday 28 October 2022. The pair filed similar messages on Instagram saying that “co-parenting” would be their priority. In total the couple were married for 13 years; they have two children together, Benjamin (12) and Vivian (9). They also parent Brady’s first child Jack (15), who he had with former girlfriend Bridget Moynahan.

In breaking the news to his followers, Brady said that the couple “arrived at this decision [to divorce] amicably and with gratitude for the time we spent together.” Brady said the priority for the couple is their children and that they plan to “work together as parents” to “ensure they receive the love and attention they deserve.”

Did Bündchen and Brady sign a pre-nup?

With rumors of a possible separation or divorce swirling between supermodel Gisele Bündchen and NFL quarterback Tom Brady, many are wondering what such a situation could do to their finances. Both Bundchen and Brady are independently wealthy, a strong indicator that they may have signed a prenuptial agreement when they were married in 2009.

Bundchen has a higher net worth than her husband, clocking in at around $450 million, while Brady’s is closer to $250 million.

People magazine has reported that Gisele Bundchen has contacted a divorce lawyer, but this is far from the first time that the media has speculated about a possible separation from Brady.

Did the couple sign a prenuptial agreement?

A prenuptial agreement, or a prenup, is a legal document signed by a couple before they get married, in the case that they decide to divorce later down the line. Many see the concept as a bad omen, but for others, it is a financially savvy thing to do to protect one’s assets and income. When a couple divorces and does not have a prenup, there is a standard way of dividing assets that may seem unfair to one or both parties; a prenup can give the couple power to determine what they would see as a fair splitting of assets in the case of a divorce.

The Things reported on a conversation with an insider close to Bundchen, saying that “The current prenup is pretty ironclad and lists how everything will be divided should they break up, but it needs to be updated, and it can be if both parties agree.”

The same source noted that “Gisele is rich in her own right” and that many people in her life were saying she would “be nuts not to revise their prenup.”

If this source which claimed to be close to the couple, is correct, then the couple did, in fact, sign a prenuptial agreement before getting married. With such high net worths, the idea that they hadn’t signed a prenup would be more surprising.

A lawyer that People spoke with, Jacqueline Newman, assumes that the couple probably has a lot of their finances “worked out” and that there probably exists a “prenuptial agreement that’s going to dictate a lot of this, but if there are some properties that were purchased while they were married — marital residences — there may be fights about that.”

Where could issues arise?

Additionally, there could be potential issues over the custody of their two children.

Brady also has a third child from his former girlfriend, who was born just as he and Gisele began their relationship in 2007. Newman alluded to possible tensions over custody, saying, “I’m sure he [Brady] is dedicated to the children, but he travels a lot. He’s not involved as much in the day-to-day. She may want more stability for them.”
