DirecTV settlement up to $400: Who can get it and how to claim payment?

DirecTV has reached a settlement following a nationwide class action lawsuit for $16.85 million, to resolve claims that it violated the Telephone Consumer Protection Act of 1991.

According to the lawsuit, the satellite television subscription company made unsolicited phone calls to people whose numbers were on the National Do Not Call Registry. The National Do Not Call Registry collects the phone numbers of people who do not want to receive advertising calls.

West Virginia consumers have sued DirecTV, alleging that it is legally responsible for telemarketing calls made by DirecTV distributor AC1 Communications to people whose phone numbers were on the registry.

Consumers alleged that these calls violated the TCPA, which prohibits telemarketers from initiating two or more calls in a calendar year to numbers on record.

The settlement benefits persons in the United States whose phone numbers were placed on the National Do Not Call Registry but received more than one call within any 12-month period from DirecTV distributor AC1 Communications. The 113,997 specific phone numbers are listed in a sealed court filing.

Under the terms of DirecTV's TCPA agreement, individuals who receive certain telemarketing calls from AC1 Communications may obtain an estimated minimum cash payment of $324. The average estimated cash payment is more than $461.

Settlement payments will come from the $16.85 million settlement fund, which will also be used to pay for the costs of notifying people of the settlement, attorneys’ fees, and awards to people who helped bring the lawsuit to court. The deadline for exclusion or objection is Aug. 7, 2023.

To receive a settlement payment, those on the list must submit a valid claim form by this deadline. Persons they can verify if their phone number is included in the agreement by visiting the administrator’s website.

To register your phone number on the National Do Not Call Registry or for information about the registry, visit donotcall.gov, or call 1-888-382-1222 from the phone number you want to register. You will start receiving fewer marketing calls 31 days after you register your number.
