Florida Abortion Referendum in November: Everything you need to know

This November’s ballot will feature a referendum on abortion rights, giving voters the chance to directly impact the future of access to safe abortions.

Despite continued Republican attacks on the right for a legal and safe abortion, the Florida Supreme Court has decided that the people of the state will have the deciding vote on its legality.

The potential amendment says that, with exceptions for parental notification of minors who get abortions, “no law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider.”

The vote would need 60% of votes to pass.

The recent permitting of a 6-week abortion ban by Florida lawmakers has severely restricted access for many women. The upcoming referendum offers a chance for voters to potentially overturn this ban and prevent similar restrictions in the future.

What each vote means

A ‘yes’ vote would be to approves the amendment, guaranteeing abortion access up to a certain point in pregnancy (fetal viability is typically around 24 weeks). This would also overrule recent Florida legislation restricting abortion access.

A ‘no’ vote rejects the amendment, leaving abortion access subject to existing and future laws.The 15-week abortion ban recently upheld by the Supreme Court would remain in effect.

When will the vote take place?

The referendum will be held on Election Day, 5 November, 2024. Make sure you are registered to vote and have your voice heard.
