There’s been a leak of discovery materials in the election subversion case against former President Donald Trump in Fulton County in Georgia, causing prosecutors to renew their call for a protective order for materials in the case.

Some media outlets reported on videotaped statements from Trump co-defendants- former Trump lawyers Jenna Ellis, Sidney Powell and Kenneth Chesebro- as well as Atlanta-based bail bondsman Scott Hall.

What did the leaked videos in the Georgia Trump case show?

The leaked videos included conversations between the co-defendants and the prosecutors. The four gave their statements as part of the plea deal they cut with the district attorney’s office in the racketeering case they are facing. The material gave more details about attempts by Trump’s inner circle to reverse the results of the 2020 presidential election in his favor.

The videos were part of proffered evidence, which refers to evidence first offered to the court to obtain a ruling on its admissibility.

Fulton County District Attorney Fani Willis had already asked for discovery materials to be protected, but renewed the motion given the recent leak of the videos.

In Willis’ filing, she asked that the court enter an emergency seal on all discovery materials in order to protect witnesses and to safeguard sensitive and confidential information.

How does the Donald Trump video leak affect the 2020 election subversion case according to Georgia prosecutors?

“Public release of information contained within discovery could subject witnesses to harassment and threats prior to trial, which could discourage cooperation and candor,” according to the filing.

“Premature public discussion or release of information could also affect the jury pool.

Because of the leak, the prosecution also states that copies of confidential video recordings of proffers will no longer be given to any defendant to prevent any more information being released to the public.

“Defendants must come to the District Attorney’s Office to view confidential video recordings of proffers. They may take notes, but they will be prohibited from creating any recordings or reproductions,” per the filing.
