How is Elizabeth Holmes delaying her entry into prison? When will she start her sentence?

The convicted fraudster has again delayed when she will enter prison though with her accomplice behind bars it is only a matter of time before jail time.

Theranos founder Elizabeth Holmes has successfully extended her time out of jail by appealing her conviction for fraud. Her conviction was for four counts of fraud in misleading rich investors for the blood-testing firm.

She was facing an 11-year jail sentence on 27 April but the appeal automatically delays her incarceration by a month, meaning she could be in prison before the end of May.

Back in November, the judge overseeing the case sentenced her to 135 months in prison but delayed her incarceration date until 27 April due due to her being pregnant with her second child at the time.

While out of prison Holmes has been living with her partner and two children in a $135 million SIlicon valley estate.

The appeal seeks a new trial based on alleged wrongdoing by the prosecution.

Her former business partner Sunny Balwani attempted a similar plan to avoid his own prison sentence, delaying his start date for a month but his appeal will be heard while he serves time.

He is serving 13 years in prison.

The Theranos founder and Balwani were both convicted of fleecing investors. He was found guilty on twelve counts related to the fraud and sentenced to twenty years. She was found guilty on four counts, three for fraud and one for conspiracy to commit wire fraud and given eleven years and three months.

Holmes has maintained her innocence throughout the court process. Her legal team claims that the conviction was the result of a number of mistakes during the trial, which they hope would allow them to overturn decision on appeal.

Federal prosecutors have claimed that Holmes is a flight risk. In January 2022 she bought a one-way plane ticket to Mexico, scheduled just three weeks after she was convicted on fraud and conspiracy charges.
