Democrats argue that President Trump is fully aware that he does not have the authority to eliminate the Department of Education.


Last week, President Donald Trump signed an executive order to eliminate the Department of Education (DOE), a move that many legal scholars—and the president himself—acknowledge will likely face court challenges. When announcing the order, Trump stated that if congressional approval were required, he hoped Democrats would join Republicans in passing a bill to dismantle the department.
Democrats across the country have been outspoken in response to Trump’s order. California Governor Gavin Newsom took to social media, sharing a screenshot from a Fox News article that confirmed congressional approval is required to abolish the Department of Education. His caption? “Even Fox News knows Donald Trump can’t actually eliminate the Department of Education,” Newsom wrote.

Washington Senator Patty Murray issued a press release condemning the order, accusing Trump of knowing “perfectly well he can’t abolish the Department of Education without Congress.”
Despite this, she warned that he could still weaken the department by gutting its operations and redistributing its responsibilities to other agencies. “Trump, Musk, and McMahon’s goal is clear: destroy public schools and enrich themselves in the process,” argued Senator Murray.
