Elon Musk loses key lawsuit against OpenAI’s Sam Altman over the future of AI

The case has been one of the biggest tech lawsuits of the decade.

Elon Musk has lost his lawsuit against OpenAI after a U.S. jury on Monday dismissed the lawsuit filed by the entrepreneur against the organization and two of its top executives, Sam Altman and Greg Brockman. The ruling, issued by a federal court in Oakland, concludes that the artificial intelligence startup did not betray its original mission to operate as a nonprofit dedicated to the public good by evolving into a for-profit entity.

The South African-born tycoon was seeking $150 billion in damages. Musk was one of the founders of OpenAI in 2015 and alleged that Altman took advantage of his initial contributions to the nonprofit’s capital, knowing that the company would eventually become a for-profit enterprise.

The lawsuit has been dismissed because the court found that Musk waited too long to file his claim, causing it to become time-barred. According to the ruling, the businessman had three years to file a claim regarding an alleged breach of OpenAI’s charitable status and two years to challenge alleged unjust enrichment by Altman and Brockman.
