a) INTRODUCTION AND DEFINITIONS.

After reading and accepting this Meristation Services Privacy Policy, you will be able to enjoy these services. By accepting this clause, you expressly accept the Meristation Services Privacy Policy as the user of any of the media or services and/or products Meristation makes available to users on the Internet – free of charge or requiring payment – that consist of access to different news, content, programmes, apps, stores, e-commerce websites, videos on demand or similar (hereinafter Meristation Services). To ensure the correct understanding of this Meristation Services Privacy Policy, the following definitions have been established: The user is any natural or legal person who accesses and/or uses any Meristation Services by any means, without the need to register. By accepting this clause, the user accepts the Meristation Services Privacy Policy as set out in this document. Meristation Services cover services, products and promotional actions, be they free of charge or require payment, that consist of access to different news, content, commercial, editorial and corporate communications, programmes, applications, stores, websites, videos on demand or similar. The Meristation Services Privacy Policy applies to:

  • Browsing by the user on any Meristation web page or Meristation mobile app.
  • Access as a user to any content via any other Meristation media or service.
  • Browsing carried out from any device that enables access to Meristation Services or content, such as computers, digital televisions, smart TVs, PDAs, tablets, iPads, iPhones, mobile phones, smart phones, RSS subscriptions or any other means of access to the content made available on the Internet.
  • Browsing and use of Meristation Services carried out from any part of the world, be they services located in the country of access or in another country.

b) COMPLIANCE WITH CURRENT LEGISLATION.

As it is located in Spain, Meristation is subject to compliance with Spanish and European legislation on data protection and information society services. Meristation therefore guarantees complete compliance at all times with the obligations set out in legislation on data protection and information society services, and in any other law or regulation that complements or replaces the former.

c) PERSONAL DATA CONTROLLER.

Personal data collected through Meristation Services will be entered on a file managed by Diario AS, S.L., a Spanish company with registered office at C/ Valentín Beato, 44 – 28037 Madrid, with registered company number C.I.F.: B-81511834, registered in the Mercantile Registry of Madrid, volume 11.181, section 8, sheet 184, page M-175.966, entry 3 (hereinafter Meristation). As a company that is part of Grupo Prisa, Meristation has a data protection officer to which the user can submit complaints, claims and suggestions relating to the processing of their personal data, and exercise their rights. d) PURPOSES OF THE PROCESSING OF USERS’ DATA.

The data provided by the user of Meristation Services is used for a range of purposes, which are detailed as follows:

  • To provide a personalised service to the user, adapting this service to their personal and geographical profile, and to their preferences and tastes.
  • To define user types, segments and profiles, and to provide, manage, extend and improve the services and/or content offered as part of Meristation Services, via the analysis of users’ use of the services.
  • To show editorial or commercial information specifically designed for the profile inferred from the use of Meristation Services by the user, be they Meristation’s own services or third-party services belonging to any of the sectors with which Meristation reaches an agreement. Said profile can be inferred from the geographical location of the device or terminal from which Meristation Services are used; however, prior and explicit authorisation will always be requested before such information is processed.
  • To design new services that could be of interest to the user.
  • To manage issues with, and the maintenance of, Meristation Services.

e) TYPES OF DATA COLLECTED THROUGH MERISTATION SERVICES.

Meristation will collect data from the user through their use of Meristation Services. This data will principally be linked to the IP address from which they access Meristation Services or to a user code unilaterally assigned by Meristation. Such information may be considered personal data to the extent that it allows the user to be identified or rendered identifiable. Meristation may link the following data to their IP address or user code:

  • Usage and browsing data. For statistical and advertising purposes, to monitor the use of our pages, to monitor access to third-party services through Meristation Services and to gain improved knowledge of the interests of the user, usage and browsing data will be collected relating to which service the user uses; how they use it; when they use it; what type of user they are; and whether they access an advert shown in any of the Meristation Services.
  • User profile and interests inferred from the user’s browsing or use of Meristation Services, and information on the device of access, equipment model, the version of operating system, the device or connection’s unique identifiers, mobile-network information, errors, system activity, hardware settings, the type of browser, the browser language, the date and time of the connection request, the referral URL, cookies and other data storage and recovery mechanisms in terminal equipment (as is explained in the Cookies Policy) which allow the user’s browser and device to be identified, analytical studies to be carried out and personalised information to be shown depending on the result of said studies, both in Meristation’s own services and external services. By signing up to any of the Meristation Services, you accept, expressly and unreservedly, the Cookies Policy.
  • Meristation Services also use technologies for identifying and tracking users such as tiny, transparent images inserted in web pages and applications. When the user accesses this content, the images are downloaded onto their device and make it possible to know that the user has accessed the Meristation Service and to recognise the user if they access it again. This information is used to obtain statistics, carry out analytical studies on users’ use of the services, and to show editorial and commercial information that is personalised depending on the result of said studies, both in Meristation’s own services and in external services.
  • Meristation Services may also offer links to third-party services identified with a code that allows said third parties to recognise that a user arrived from a Meristation Service.
  • Information on the location in which the connection to Meristation Services takes place, to personalise said services and, if applicable, to verify the availability of the viewing rights to certain audiovisual content.

f) DATA SHARED WITH THIRD PARTIES.

Meristation will not cede users’ personal data to any third party without legal grounds justifying such processing. To analyse the use of our services, Meristation uses external suppliers who use cookies to undertake analytical studies of the use of Meristation Services. The user can consult the Cookies Policy at any time.

g) UNDER-AGE USERS.

Meristation Services are aimed at people over the age of 14. Those under the age of 14 should not use Meristation Services without the consent of a parent or legal guardian. If Meristation detects users that could be under the age of 14, it reserves the right to request identity documentation to verify their age, and/or to cancel the service.

h) USERS’ RIGHTS.

The user may exercise their right to access, rectification, erasure, objection, portability and limitation, by contacting Meristation by post, verifying their identity with a scanned copy of their national identity card or equivalent document, and specifying the right they wish to exercise. It is recommended that the user provide all information on the Meristation Services they use and have used, in order to be able to properly process their request. The user will have the right to submit a complaint or claim to the Spanish Data Protection Agency (www.aepd.es) and the Grupo Prisa data protection officer (dpo@prisa.com).

i) DATA RETENTION PERIOD.

The user’s personal data will be actively processed as they long as they can still be considered a user of Meristation’s services; that is to say, as long as they do not exercise their right to erasure. If they exercise their right to erasure, their data will be blocked and retained in a restricted manner for the purpose of being available to the competent authorities for a period of five years, in order to attend to potential liabilities arising from its processing.

j) LEGAL BASIS FOR PROCESSING USERS’ DATA.

The legal basis that legitimises the data processing described above is Meristation’s legitimate interest in providing and supervising access to Meristation Services.
