Date set for Super League trial in Madrid

Following the European Court’s ruling on whether FIFA had a dominant position, the trial will take place in the Spanish capital.

The trial for the European Super League case returns to Madrid. Commercial Court No. 17 in the Spanish capital has summoned the relevant parties for the hearing, a single session, which will start at 10 a.m. on 14 March. The citation arrives following last month’s ruling by the Court of Justice of the European Union (CJEU), which affirmed that FIFA and UEFA abused their dominant position in the market.

The judicial course of the Super League has not ended - despite the fact that some thought otherwise with December’s ruling by the CLEU. The original complaint was made in the courts of Madrid, who in turn raised the question to the CJEU about whether UEFA abused a dominant position in what is essentially a free market. The ruling issued on December 21 concluded that both FIFA and UEFA abused their dominant position. However, it was never positioned in favor of the Super League and the viability of the project, as UEFA president Aleksander Ceferín and Javier Tebas emphasized during their appearances.

What next for the Super League?

Now that the doubt of whether UEFA’s dominant position existed has been resolved, the Super League case returns to Spain and could usher in changes to how European competitions are structured in the future. A decision will be taken in Commercial Court No. 17, where the first hearings were held. The Super League denounced UEFA and FIFA in 2021 for preventing them from moving forward with their proposed project and for also announcing sanctions against participating clubs - prohibiting them from playing in the Champions League and issuing economic fines. A punishment which the Commercial Court stopped at the time.
