The Gavi case is still not over
LaLiga is preparing a notice of opposition which will be sent to Barcelona’s Commercial Court No.10. A judge will decide whether to maintain or raise the precautionary measures.
The Gavi case is not over yet. LaLiga is preparing notice of opposition (the legal term used when a precautionary measure is alleged) which will be sent to Commercial Court number 10 in Barcelona. The court demanded that the body presided over by Javier Tebas provide “everything necessary” for Gavi’s registration. LaLiga complied with the judicial measure, although the decision was taken without having heard their arguments (hence the very precautionary nature), so now they are preparing the opposition document that they will send within the next two weeks. The Court will then summon LaLiga to make a statement and decide whether to maintain the precautionary measures or increase them.

If the measures are increased, Gavi would be “unregistered” from the first team squad again. That could open the door to a possible free exit for the midfielder. The substantive claim of Barça for its dominant position in LaLiga will remain pending after the resolution of the precautionary measure, the club’s second of 2022. Barça also filed a complaint before the Commercial Court for the issue of fairplay. Barça has filed a complaint, to denounce that it cannot use 15% of the 90 million euros right deal from Sixth Street television, while clubs that signed the contract with the investment fund CVC are able to make use of that extra 15% income.
While the war between Barça and LaLiga intensifies, the league believe that the Barça intentionally staged the conflict with the Gavi case because it had made the salary space almost necessary to register the footballer during this January window. However, Barça clung to the possible “irreparable damage” that would result from not registering the player with the first team (he could be released on 30 June if his contract renewal is not approved) to go to court. Now we must wait for the court’s resolution to see if calm can be restored or whether the club will have to work quickly have everything ready and be able to register Gavi on 1 July, when the summer transfer window opens ahead of the 2023-24 season.
