Judge Mary Marlowe Sommer dismissed with prejudice the involuntary manslaughter trial against Alec Baldwin on Friday. She ruled that the police and prosecutors had withheld evidence from the actor’s defense team.

Baldwin sobbed when the judge made her ruling dismissing the trial with prejudice and hugged his attorneys and wife. “There is no way for the court to right this wrong,” Judge Sommer said.

The decision to dismiss the trial, in which Baldwin could have faced up to 18 months in prison if found guilty, came after a sealed manila envelope containing previously unexamined evidence was brought into the courtroom. Judge Sommer got down from the bench and opened it with a pair of scissors while wearing latex gloves. Inside was ammunition that was connected to the case.

Baldwin’s lawyers called for the trial to be dismissed with Luke Nikas saying “They buried it. They put it under a different case with a different number.”

The actor and producer of ‘Rust’ accidentally shot Halyna Hutchins, the cinematographer, during a rehearsal in October 2021. He was handed what he was told was a ‘cold gun’, that is one without live ammunition in it and pointed it at Hutchins as instructed.

He has repeated said that he pulled back the hammer on the revolver and that it misfired without him pulling the trigger. A live round struck Hutchins and the film’s director, Joel Souza. Hutchins was taken by helicopter to the University of New Mexico Hospital, where she died, while Souza was released hours later.
