Florida girl compensated with $800,000 after nugget burn at McDonald’s drive-thru

The family of the victim, a seven-year-old girl, asked for up to $15 million for the burns, and according to the lawyer, the girl “still asks to go.”

Fast food franchises have long been known to attract children with enticing toys found within their children’s menus. However, the tradition of eagerly unwrapping these little surprises seems to be waning, as some kids now prioritize devouring their food over playing with the accompanying trinkets. Nevertheless, an unforeseen incident at a McDonald’s in Tamarac, near Fort Lauderdale, Florida, resulted in a compensation claim of nearly one million dollars.

Not lovin’ it: burning McNugget

The incident took place in 2019 when four-year-old Olivia Caraballo reached out to grab a McNugget from the McDonald’s drive-thru window. Unfortunately, slippery hands caused the piece of fried chicken to fall, resulting in severe burns on her leg. The young girl’s distress was evident as she screamed in agony.

In the aftermath of the accident, Olivia’s family filed a compensation claim against McDonald’s, initially requesting a staggering 15 million dollars for damages. The court did rule in favour of the family, although not for that amount, finding McDonald’s liable for the injury, awarding Olivia $800,000 in damages for the pain, suffering, and mental anguish caused by the incident.

Burnt child still enjoys McDonald’s

The family’s legal team were clearly satisfied with the verdict, considering it a significant win. Olivia’s mother, Philana Holmes, spoke to the media after the trial, expressing her relief that her daughter’s voice was heard and justice was served. Despite the incident, Holmes stated that Olivia still visits McDonald’s and occasionally enjoys chicken nuggets, although she now exercises extra caution to avoid such accidents.

Olivia’s injury, as well as her expressions of pain, were presented as evidence during the trial. Her family’s attorney, Mrs. Jennifer Miller, emphasised the severity of the second-degree burn scar and Olivia’s anxiety to have it removed.

McDonald’s, one of the most recognisable brands in the world, will now hope that this has not set a precedent that could lead to a significant payout for others. While the jury’s decision may serve as a reminder for businesses to ensure the safety of their products and services, it also highlights the importance of being mindful while enjoying fast food, especially when children are involved.
