Update:

Rep. Ro Khanna (D-CA) slammed Vice President J.D. Vance during a speech at Yale Law School, the alma mater of both politicians.

In an interview with progressive media commentator Joe Gallina after the speech, Khanna said: “I gave a major speech about standing up for freedom of thought and the Constitution and the rule of law at Yale Law School where J.D. Vance and I both went. And I said: “J.D. Vance’s positions are a stain now on the degree of every Yale graduate.” And I got the largest applause.”

Khanna, who graduated from Yale Law in 2001 and is a prominent progressive voice in Congress, expressed alarm over Vance’s recent actions and statements, which he believes undermine democratic principles.

Vance’s stance on executive power and judicial authority

Vice President J.D. Vance has publicly suggested that executive branch should not be bound by certain judicial decisions. In a 2021 podcast, he stated that the executive should “simply refuse to comply with judicial decisions limiting its power.” He reiterated this stance in a 2024 interview, implying that the president could ignore Supreme Court rulings deemed “illegitimate.” This position runs directly contrary to the US constitutional principle of checks and balances, where the judiciary interprets the law, and the executive is expected to enforce it.

Association with Project 2025

The current Vice President also wrote the foreword for “Dawn’s Early Light,” a book linked to Project 2025, which advocates for significant restructuring of federal institutions to consolidate executive power. The book suggests actions such as dismantling the FBI and replacing civil servants with loyalists, which critics argue could undermine the rule of law and the nonpartisan nature of federal agencies.

Removing due process from immigration policies

Vance has supported policies that limit judicial oversight in immigration enforcement, including advocating for the use of military forces for mass deportations without due process. Such actions have been criticized for violating constitutional protections under the Fourth, Fifth, and Fourteenth Amendments, which guarantee due process and equal protection under the law.

Questioning the 2020 Election Results

Vance has continued to question the legitimacy of the 2020 presidential election results, where Trump lost to Biden. The current Vice President has suggested that votes should not have been certified immediately and advocated for the submission of alternate slates of electors. These actions align with efforts to overturn certified election results, raising concerns about adherence to constitutional processes governing elections.
