He faked being an In-N-Out employee for YouTube pranks and now he’s getting sued by the company

In the quest for clicks, Bryan Arnett found himself in the middle of a lawsuit. Is is illegal to impersonate a store employee?

Youtuber Bryan Arnett has built up a large following on the popular video sharing platform, delighting his fanbase of over 334,000 subscribers with content mainly focused on skating.

Occasionally Arnett branches out to produce content on other theme - always looking to do something a little out of the ordinary such as living off vending machine food for three days.

Arnett’s lewd burger prank backfires

One of his most recent creations has landed him in hot water. Arnett allegedly impersonated a In-N-Out Burger worker, filming his interactions with customers, then posting the results online.

Now the fast food chain is suing him for illegally impersonating an employee with the aim of misleading customers and falsely representing the brand.

The lawsuit which was filed in district court in central California on Friday, alleges that the Youtuber “visited multiple In-N-Out locations in Southern California … wearing a fake uniform bearing In-N-Out’s trademarks. [Arnett] made lewd, derogatory, and profane remarks, such as stating that In-N-Out had cockroaches and condoms in its food, and that In-N-Out Associates put their feet in lettuce served to customers.”

In-N-Out Burger argues that the defendant made “defamatory, insulting, racially insensitive, bizarre and lewd remarks” in a deliberate attempt to damage the comnpany’s reputation.

The chain requested that Arnett remove the videos from Youtube. They have subsequently been removed from public viewing.

So what felony did Arnett commit? He could be charged for trespassing and fraud, selling items while dressed as/ impersonating an In-N-Out Burger employee. In-N-Out seek to ban Arnett from its restaurants for life, want a resolution regarding the money that the prankster made from his videos, and any potential financial damages incurred.
