A judge at the New York Supreme Criminal Court has set November 12 as the tentative date for the retrial of convicted sex offender Harvey Weinstein on rape charges. The one-time movie mogul was briefly present in court where prosecutors and the defense discussed matters involving evidence.

Judge Curtis Farber said he was open to moving the trial earlier to September, depending on the developments in pre-trial discovery. Weinstein’s legal team said they want the trial to take place as soon as possible.

The former Miramax producer was sentenced to 23 years in prison in February 2020 on rape charges, but in April of this year, the New York Court of Appeals threw out the conviction.

The state’s highest court ruled he did not receive a fair trial because the judge made a mistake by accepting testimony that was not part of the charges he faced. The court then ordered a new trial for Weinstein.

Despite the overturning of his conviction in New York, Weinstein is in Rikers Island jail because he was also sentenced to 16 years imprisonment after he was found guilty of rape in a California trial in 2022.

Prosecutors said they planned to file more charges against the 72-year-old for additional violent sexual assaults after more women consented to testify. They said they are still evaluating the victims’ allegations, but admitted to Farber that they had not yet brought any findings to a grand jury. They added that they intend to present the accusations of at least one alleged victim to the jury.

The disgraced movie magnate has repeatedly claimed he is innocent and that he never engaged in non-consensual sex.
