Update:

MGM Resorts International suffered two data breaches, one around July 2019, and a second separate incident that occurred around September 2023. Now, the settlement has been agreed, and it will see those affected remunerated from a pot of $45 million.

The breaches saw huge amounts of private information of customers and guests leaked, including names, addresses, telephone numbers, email addresses, dates of birth, drivers' license numbers, passport numbers, Social Security numbers, and military identification numbers.

The Resorts company reported a 10-day computer shutdown in September in an effort to shield such data from a cyberattack.

How can I claim from the MGM data breach?

Those in the United States “whose private information was compromised because of the data incidents and who were sent notice” are eligible for a repayment, says the settlement website.

Eligible people will be sent notices that “include information about eligibility and a Unique ID and PIN that can be used to file a Claim Form.”

Any financial losses related to the breaches, up to $15,000, can also be claimed.

Documentation “includes receipts, voided checks, bank statements, or other documents showing the amount of your losses and/or a detailed narrative description.” Certain Settlement Class Members are also eligible to receive a flat cash payment, without providing documentation.

In addition to the flat cash payments, all who are included in the settlement and file a claim are eligible for one year of financial account monitoring.

Tiered Cash Payments:

  • Tier 1 Cash Payment – If your Social Security number or military identification number was exposed, you may be eligible to receive an estimated $75.00 flat cash payment.
  • Tier 2 Cash Payment – If your passport number or driver’s license number was exposed, you may be eligible to receive an estimated $50.00 flat cash payment.
  • Tier 3 Cash Payment – If your name, address, and/or date of birth was exposed, you may be eligible to receive an estimated $20.00 flat cash payment.
