Thousands of Americans to receive up to $11,000 as part of Ardagh Glass data breach settlement: you only need this document to claim

Ardagh Glass has reached a $2.75 million settlement as part of a class action lawsuit claiming that the company failed to prevent a 2021 data breach.

Data breaches of companies can be costly, not just for the company but the individuals who are affected. For the latter group, they have to deal with paying the costs of identity theft, which can result in miscellaneous expenses that the cybercriminals rack up especially on their credit. Then they have to spend hard earned money to hire professionals to help solve the problem.

Unless the company is proactive in a sufficient manner to help assuage the damage done to those who were affected, the people whose personal data was stolen will in all likelihood take the company to court to demand recompense.

That is the case with Ardagh Glass, a Luxembourg-based supplier of metal and glass packaging solutions, which was hit by cybercriminals in 2021. It has reached a $2.75 million settlement, but admits no wrongdoing, as part of a class action lawsuit claiming that the company failed to prevent that data breach.

Ardagh Glass’ network was breached between April 23, 2021, and May 19, 2021 according to Top Class Actions. The over 5,300 individuals whose personally identifiable information was allegedly compromised can each receive up to $11,000 in reimbursement for out-of-pocket expenses that resulted from the breach.

The expenses that claimants may be reimbursed for “include fraud or identity theft costs, professional fees, credit expenses and other miscellaneous expenses,” states the online website dedicated to legal settlements. Additionally, “claimants can also receive compensation for five hours of lost time compensated at a rate of $25 per hour.”

The administrator of the settlement will make pro rata cash payments from the remaining settlement funds to each party in the class action lawsuit once the reimbursements have been distributed. There is currently no estimate of what that amount could be.

As well as reimbursement payments, each member of the class action lawsuit may receive three years of free credit monitoring and identity theft services from the three bureaus. Class members will also get a policy of $1 million in identity theft insurance.

A valid claim with the necessary documentation must be submitted on or before November 27, 2024, the window to be excluded or object to the class action lawsuit has already passed. Claims must be filed under penalty of perjury. Fraudulent claims may harm valid claimants by reducing funds available to those who are eligible.

In order to prove the expenses that were incurred claimants may include bank statements, credit reports, or receipts as well as legal documents.

Those who do not make a claim will still automatically receive the pro rata payments but will be excluded from receiving any other benefits, along with the credit monitoring services.
