Testimony from witness in Torbe case

The morning TV programme hosted by Ana Rosa Quintana: 'El programa de Ana Rosa’, has exclusively published extracts of the testimony made by a protected witness during investigations into the activities of Spanish pornographer Ignacio Allende Fernández ‘Torbe’ and in which Spanish footballers Iker Muniain, Isco and David De Gea were named.

According to police statements already obtained, the protected witness stated that David de Gea had arranged, through Torbe, for two footballers to meet her and another girl at a five star hotel in central Madrid, where according to the witness they were raped.

Footballers named: Iker Muniain, Isco and De Gea as intermediary

In her statement, the protected witness named the footballers as "Iker Muniain, Isco and an intermediary - David de Gea". And added: "The other girl stayed on a lower floor with one player while I went up stairs with one of the others. They made us strip our clothes off, ordered us down on our knees and started to abuse us", recounted the witness, who insisted that the players warned them not to speak about the incident. "The players said to us that we had to be careful, that we could not take any kinds of photographs or tell anyone what had happened”.

Witness struggled to officially report alleged crime

During a direct examination by the judge, the witness claimed that she saw cocaine on one of the bedside tables in the hotel room and that they players physically abused them, adding that the sexual acts they were involved in were not consensual.

The witness explained that following the encounter, she made contact with one of the players to have proof for when she mustered up the courage to make a formal complaint, because their first statements, given to Police in Murcia, lacked some of the information and details which only later would they dare to include in later statements.

Questioning by protected witness by judge

Below is an extract of the direct questioning of the protected witness by the judge after the initial testimony had been given:

Judge: You say that there was cocaine in the room?

Protected witness: Yes, on one of the bedside tables.

J: Did the police ask you to name the players in your first statement?

PT: Yes. I seem to remember they did.

J: And did you give the names of the footballers?

PT: Yes, in the UCRIF (Police unit which deals with Human trafficking and false documentation) in Murcia.

J: In Murcia? I am asking you because you did not specify that in your statement.

J: Who were the players involved? I am asking you to corroborate what you are saying.

PT: Iker Muniain, Isco and, as the intermediary, David de Gea.

J: You have said that these football players assaulted you, is that correct?

PT: Yes.

J: That you took part in sexual activity, under threat, is that correct?

PT: Yes.

J: You did not give your consent?

PT: That's right, nor did the other girl.

J: Afterwards, did you maintain any kind of relationship with these players?

PT: No. The conversation on Whatsapp was to have proof for the day when I felt brave enough to make a formal complaint.

J: Of course, in that conversation on Whatsapp. One with Iker Muniain, did you say that you enjoyed the night which the four of you spent together at the hotel?

PT: I only said that to verify that we were really there.

J: And with De Gea, did you say that if they were to organise a party with five friends, you would be able to attend to all five?

PT: I said that to get information.

J: Why did you not disclose that to the police or tell the police in Murcia?

PT: I did mention it to them.

J: No, you only mentioned it in May of this year but not in that first statement in Murcia.

PT: Well obviously because I was in shock and I couldn't use the images I had saved in an e-mail.
