In Mallorca, Spain, a group of neighbors attempted to remove a fellow resident’s dog from the community.

They took the matter to court, alleging that the dog posed a danger to the building’s residents. According to the complaint, the dog had bitten two neighbors and was a nuisance due to its constant barking, as reported by Última Hora.

The legal dispute

The homeowners’ association asked the judge to recognize the situation as a “dangerous activity” taking place in the residence and requested that the owner either remove the animal or stop keeping it at the property.

They also sought to suspend the owner’s right to use the home for two months, arguing that he failed to take appropriate safety measures. The case was brought to court in 2023 after the association filed a formal complaint.

Not all neighbors agreed

However, not everyone in the building supported taking legal action. Some neighbors sided with the dog’s owner, though they acknowledged that the dog had a temperamental nature, often barking or growling at strangers and other residents.

The owner admitted the dog had been involved in two aggressive incidents but denied the other accusations. The court also considered whether the barking qualified as a noise nuisance, but ultimately concluded that it did not meet the required “continuity and persistence” to be considered excessive.

In addition, the ruling noted that the homeowners’ association had only attempted to send one certified letter to the dog’s owner, which was never actually received.

After the ruling, the dog’s owner requested that the court order the association to cover his legal expenses. However, the judge rejected the request, stating that the case had presented serious doubts.
