Time is running out to file a compensation claim from $45 million Walmart settlement involving overcharging for bagged fruit or meat products by weight.

Walmart $45 million settlement: Who is eligible for payment?

In November, Walmart settled a class-action lawsuit brought against the retailer in 2022. According to official documents, the company was accused of overcharging customers who purchased what is referred to as “weighted goods”, or products marked with unit prices according to their weight. The company still denies the allegations and any wrongdoing.

Some Walmart customers may be eligible for a portion of the $45 million settlement resulting from a class-action lawsuit against the world’s largest retailer. They have until 5 June 2024 to make a claim or opt-out if they want to reserve their right to continue litigation.

Walmart $45 million settlement: Who is eligible for payment?

Any person who has purchased products sold by weight in any of the Walmart stores in the United States and Puerto Rico between October 19, 2018 and January 19, 2024, is eligible to receive compensation.

These products include everything from beef, chicken, pork, turkey and seafood to oranges, tangerines and grapefruit weighed in plastic or mesh bags. On the official site of the agreement, you can consult the complete list of products.

Walmart $45 million settlement: How to submit a claim

Customers who purchased any of these product can submit the Important Documents Claim Form on the website enabled for the agreement. The company makes it clear that unless clients exclude themselves from the agreement, they will automatically be part of it. However, if they do not claim it, they will not receive any payment and they will give up the right to sue the company for the same or similar matter.

To exclude yourself from the agreement, you can submit an “opt-out request”. Through this, you are excluded from payment, but you are allowed to retain your right to sue the company for legal claims similar to or already resolved in this agreement.

Despite the settlement, Walmart has denied any wrongdoing in the issue.

Those who wish to claim part of the million-dollar compensation will have to present their respective purchase receipts. With them, they will be able to claim up to 2% of the total cost of the product. The maximum to receive is $500 per customer.

If the purchase receipt is not available, customers can still qualify for a payment of between $10 and $25, depending on what they purchased. Those who purchased 1 to 50 products are eligible to receive $10. Those who purchased 51 to 75 products will receive up to $15, and those who purchased 76 to 100 products can receive up to $20. Customers who purchased 101 or more are eligible for a payment of $25. The deadline to file a claim is June 5, 2024.
